GARAGE-LOCATION PATRICK SA: GENERAL CONDITIONS OF RENT FOR ONLINE BOOKINGS

1. General booking conditions

1.1 This booking does not constitute a vehicle rental agreement. The vehicle rental service (“Rental Service”) will be regulated by a separate rental agreement which is agreed with the respective Patrick Garage-Location office (“Location”) that will provide the rented vehicle.

1.2 1.2 When you choose the option "online payment" or "payment on location", you agree to a reservation with Garage-Location Patrick S.A. ("GLP").  Any booking not cancelled within the free cancellation deadline will be charged. 

1.3 When you choose to pick up a vehicle during our closing hours or on a holiday. You will see the following message in red on the website above the booking confirmation and/or in the booking confirmation that you receive by email: “Please visit our location during opening hours before the rental period commences in order to pick up the vehicle keys.” In this case, no refunds will be made other than those listed under points 2.5 to 2.8 below.

2. Terms and conditions for online payment

2.1 By ticking the box “I have read and accept the general terms and conditions of online booking”, you agree to this booking with GLP and will be subject to our terms and conditions. By agreeing to the booking you agree to the purchase of a “voucher” issued by GLP for the amount indicated on the quote issued by GLP. GLP will issue the “voucher”, send it to you by email and book the rental service. The “voucher” can be exchanged for the Rental Service at the location where you pick up your rental vehicle.

2.2 When booking online, the “voucher” entitling you to the Rental Service will be issued at the time of booking on the GLP website. The amount will be charged to your credit card when you book or paid on location if you have selected the option “Payment on location”. By making this reservation, you expressly authorise GLP to charge your credit card with the amount shown on your “voucher” and any additional charges stated in the booking as well as in the general conditions of rent. If you select “Payment on location”, you accept the indicated amount to be invoiced.

2.3 The “voucher”, which can be exchanged for the Rental Service, corresponds to the rental fee for the selected vehicle during the booked period including VAT and the services listed as being included in the rate when you make your reservation.

2.4 Any items not featured in the list of services included in your booking (e.g. optional equipment, fuel, additional days or mileage, optional insurance) will be charged extra and must be paid directly at the Location when picking up or dropping off the vehicle.

2.5 If you cancel your reservation at least 3 days before the date and time of the beginning of the rental period, a cancellation fee of CHF 50.00 will apply.

2.6 If you cancel your booking within 3 days prior to the pick-up date and time indicated in your booking, 50% of the prepaid amount or a minimum of CHF 50.00 will be charged.

2.7 If you cancel your booking within 24 hours prior to the pick-up date and time indicated in your booking, the full amount of the booking or a minimum of CHF 50.00 will be charged.

2.8 If you do not pick up your vehicle at the Location and have not cancelled in advance according to items 2.5 to 2.7, you will be charged for your booking. No refunds will apply in this case. The total amount of the booking or a minimum of CHF 50.00 will be charged.

2.9 If for any reason you are unable to notify GLP in due time, GLP shall not be held responsible and the above conditions will apply.

2.10 No refunds apply in case of force majeure and/or circumstances which are not Patrick Location’s responsibility.

2.11 Requests for cancellation or refund must be sent by post or email to the following address, clearly stating all details related to the booking as well as the refund details.

3. Booking changes

3.1 Subject to availability and the restrictions set out in clause 3.2 below, you may change your booking at any time up to the time you pick up the vehicle by calling the location stated in your booking confirmation directly. Subject to the conditions stipulated below, you may use your “voucher” as a means of payment for the modified booking.

3.2 Changes to your booking are subject to the following restrictions:
a) If the rental fee after changing your reservation is greater than the value of your “voucher”, you will be charged the difference at the time of the change at the GLP rates applicable at that time. Payment of the additional sum will be due at the time of the change.
b) If the rental fee after changing your booking is less than the value of your “voucher”, no refund will be made.

4. General information

4.1 GLP or the location cannot be held responsible for any direct or indirect damages related to a booking or a rental agreement.

GARAGE-LOCATION PATRICK SA: GENERAL CONDITIONS OF RENT

1. Start and end of the rental period

Regardless of the date of signature of the agreement, the rental period starts on the agreed date with the actual handover of the vehicle to the renter.

It ends on the agreed date on which the vehicle must be returned to the lessor along with its keys.

If the renter wishes to extend the rental period, they must inform the lessor and pay the additional rental fee immediately. Otherwise, each 24-hour period until the vehicle and keys are returned will be charged at the daily rate plus an extra  CHF 5.- per day. Weekly or monthly rates are not taken into account for the calculation of the fee (only the daily rate applies).

2. Deposit

The standard deposit is: CHF 500.- . The deposit is to be paid in cash (Swiss francs only, unless expressly authorised by the management) or by credit card (Mastercard, Visa, American Express) at the latest when picking up the vehicle. For customers who cannot prove residency in Switzerland, the deposit is CHF 1'000.-. If the deposit is not recovered within 1 year after the termination of the contract, it is kept by the lessor.

3. Handover of the vehicle

Once the rental agreement has been signed by both parties and the deposit has been paid along with the rental fee, the lessor hands the rented vehicle (key) over to the renter.

The renter is obliged to check the condition of the vehicle and to immediately report any defects to the lessor. The renter is liable for any defects that have not been reported before leaving the pick-up location.

The vehicle is delivered with full fuel, windshield wiper fluid, oil, coolant and engine antifreeze tanks as well as the Swiss highway sticker.

The renter agrees that the vehicle may be tracked with a GPS tracker and that the lessor may use or transmit this data at any time.

4. Use of the vehicle by the renter

Driver: the renter may only drive the rented vehicle if they are in possession of a valid driver's licence issued for the corresponding class of vehicle. They may authorise a third party to use it if the latter is also entitled to drive that class of rented vehicle. The renter shall be liable for any damage and violations committed by a third party who they have or have not authorised to drive the rented vehicle. The renter’s recourse against this third party remains reserved. Clauses 3.2 to 3.4 below apply equally to the renter of the vehicle and the third party.

Restrictions on use: the renter and third parties undertake to respect any restrictions applicable to the usage of the vehicle and acknowledge that they will be liable for the full amount of any damages in the event of failure to comply with these rules. The restrictions include: transporting prohibited or dangerous goods; transporting passengers for a fee; driving lessons; towing, pushing or moving another vehicle or trailer; motorsports; participation in races, trials or rallies on competition or training circuits; off-road or skilled driving events; attempts to break records; endurance competitions; participation in civil unrest or any illegal action.

European Union citizens are not allowed to enter the European Union without authorisation from the Customs.

Any change of address must be notified to the lessor within 14 days.

5. Return of the vehicle

Drop-off: the renter is required to return the rented vehicle on the date and time specified in the agreement. In the event of a delay of more than one hour, a minimum of one full day's rental will be charged based on the contractual fee. For each 24 hours of delay, an extra CHF 5.00 per day will be charged. Garage-Location Patrick SA reserves the right to charge in addition any costs or losses related to a delay, e.g. if the agreement concluded with the subsequent customer cannot be fulfilled.

The vehicle shall be returned to the lessor in a perfect operational state and clean, with all liquid levels refilled. Otherwise, a full tank of fuel will be charged to the renter with an extra charge of CHF 50.-.  The renter shall be responsible for checking and topping up the levels at least twice a week. The costs of the liquids consumed (fuel, oil, windscreen washer fluid, engine antifreeze) shall be borne by the renter. If more than one litre of oil is missing, the sum of  CHF 200.- will be invoiced to the renter for premature wear and tear of the engine.

If the vehicle has to be cleaned or rubbish removed from the car after it has been returned, a minimum of one hour’s work will be charged to the renter at an hourly rate of CHF 140.-/heure.

It is forbidden to smoke in the vehicle. In the event of non-compliance, a fee of 50.-CHF will be charged.

If an advertising sticker which is an integral part of the vehicle becomes detached or is removed during the use of the vehicle, the renter must report this immediately to the lessor so that the latter can replace it.

If, at the end of the rental period, the renter does not return the vehicle to the lessor, the latter may take back the rented vehicle or have it taken back with all costs to be charged to the renter. In such case, a minimum of CHF 500.- will be charged to the renter in addition to the extension of the contract until the vehicle is returned. The seizure of the licence plates will be charged CHF 300.-, with any other costs or more extensive damage being reserved.

The renter hereby expressly authorises the lessor or any third party designated by the latter to enter the property where the vehicle is parked in order to repossess it.

The renter shall not be liable for any losses or damage to the items inside the seized vehicle. The renter's personal belongings may be recovered from the lessor within 24 hours. After this deadline, the lessor is authorised to dispose of them since it will be presumed that the renter has renounced ownership (Swiss Act of Abandonment, Art. 729 CC).

If the vehicle is returned before the end of the contract period and/or the agreed mileage has not been used, the entire cost of the rent shall be paid to the lessor nevertheless.

Information regarding the return of the vehicle is provided upon pick-up. The renter must inquire about schedules, drop-off conditions and parking rules directly with the respective location in order to obtain the correct information.

The vehicle must be parked in such a way as to not hinder the passage or exit of other vehicles.

In the event of non-compliance with the drop-off instructions, an amount of CHF 100.00 will be charged to the renter as a contractual penalty. Please refer to our website www.patricklocation.ch for the opening hours of our locations.

The renter is responsible for the vehicle until it has been checked by the staff of Garage-Location Patrick SA. Subject to any facts unknown to Garage-Location Patrick SA at the time of drop-off. The keys must be left in the lessor’s mailbox.


6. Breakdown, accidents, and miscellaneous expenses

Accidents: The renter is obliged to inform the lessor immediately of any damage. For any damage that occurs during the rental period, the renter shall be responsible for drawing up an accident report, either by mutual agreement with the other party involved or by the police, and for stating all the facts as well as the names and addresses of the drivers involved and any witnesses.

For each insurance item, the lessor can demand a compensation of CHF 2,000.00 (CHF 1,000.00 if there is additional collision damage waiver) from the renter + CHF 250.00 for each accident and/or party involved.

For each item not declared with a European Accident Report, a lump sum of CHF 250.00 will be charged. A higher compensation covering the entire repair cost may be demanded in cases of negligence or intent by the driver. The compensation is due even if the lessor decides not to have the vehicle repaired. For the entire duration of the repairs, the renter shall pay the lessor compensation equal to the amount of the unlimited flat rate in accordance with Art. 97 CO for each day the vehicle is out of use. The repatriation costs shall be borne by the renter.

The renter shall be responsible for the vehicle until it has been checked by the personnel of Garage-Location Patrick SA, which is confirmed by the signatures on the invoice. As soon as possible, the renter must visit the location where the vehicle was provided in order to assess the damage. If the damage is significant, the lessor may demand immediate payment of the costs. The lessor reserves the right to cancel or continue the rental.

The renter shall be liable for all the expenses caused to Garage-Location Patrick SA. These expenses include, amongst others, damage to the vehicle, value at the reference date in the case of theft, depreciation, transport, expert opinions, damage processing, inability to use the vehicle, insurance deductibles and loss of bonus, costs of storage, seizure of the vehicle or plates.

The stickers are an integral part of the vehicle. Each sticker which is missing or damaged upon return of the vehicle shall be invoiced. Necessary repairs shall be made by a repair shop designated by the lessor and after the latter has agreed for the work to be started. The renter shall be solely responsible for the payment of any repairs entrusted to a third party not authorised by the lessor or without the latter’s consent.

6.6 Breakdown: The renter must inform the lessor of any breakdown as soon as possible by calling  If necessary, the lessor will appoint a third party to provide breakdown assistance and, if needed, will give their consent to do so. The renter must not abandon the vehicle at the place of breakdown. If the vehicle is abandoned, the costs of the breakdown assistance and repatriation shall be invoiced to the renter. The lessor shall not be liable for any damages caused to the renter (lost time or other indirect damages) due to any defect of the rented vehicle.

6.7 Expenses: the expenses for fuel during the use of the vehicle shall be borne exclusively by the renter. The renter shall also pay for any oil, windshield washer fluid or engine antifreeze which need to be topped up during the rental.

6.8 If a claim is made against the lessor, a lump sum of 50.-CHF will be charged as an administrative fee. The identity of the renter will be provided to the authorities and the renter shall remain responsible for the payment of any fine and related costs charged by the authorities.

The costs of opening a dossier for damages, litigation, reminders for non-payment or defaults amount to CHF 250.-

7. Liability

In addition to the liability for damage to the vehicle or to third parties according to clause 6 above, the renter shall be personally liable for the partial or total loss/theft of the rented vehicle.

The renter shall be liable for any damage that is not covered by the lessor’s insurance. The latter's recourse against the renter for gross negligence shall be reserved. The renter is responsible for the vehicle until the release of responsibility is confirmed and signed by the staff of Garage-Location Patrick SA. Subject to any facts unknown to Garage-Location Patrick SA at the time of drop-off.

By signing these General Terms and Conditions, the renter authorises Garage Location Patrick SA to charge their credit card for any expenses, compensation or damages without prior notice or issuing an invoice.

8. Lessor’s right of termination

If the rented vehicle cannot be started before the beginning of the rental period, the execution of this agreement shall be considered impossible as per Article 119 CO and the lessor will be entitled to terminate the agreement with immediate effect. The cost of the rent paid in advance by the renter will be refunded in full by the lessor, however no other or higher compensation can be claimed. If the renter fails to comply with all the terms and conditions of this agreement, the lessor reserves the right to seize the vehicle at any time without prior notice.

9. Written form requirement, choice of law and extension of exclusive jurisdiction clause

Any amendment to this agreement must be in writing. Exclusively Swiss law applies to these General Terms and Conditions together with the rental agreement. Any disputes arising from this agreement shall be under the exclusive jurisdiction of the ordinary courts of Nyon. These General Terms and Conditions are an integral part of the agreement.
